What is the Collaborative approach to divorce? 

There is a trend among divorcing couples to seek a constructive alternative to the pain and hostility that often is a result of the traditional divorce model that becomes a battle played out in court.

The spouses agree
• to reach a settlement without litigation
• to an honest exchange of information
• to create a settlement that considers the interests of each spouse and   their children

In a Collaborative Practice, the couples agree in writing to participate in a collaborative process in which they reach a mutually acceptable settlement.  This is accomplished through face-to-face meetings between the spouses and their attorneys where issues are openly and honestly discussed with the goal of reaching solutions and solving problems.  Other collaboratively trained professionals may be brought in to join the team, such as financial specialists, child specialists and mental health specialists.

The focus is on achieving an agreement which will protect the interests of the children and help both spouses move on with their lives, and to pave the way for future communication and retaining the family bonds between the children and both parents.
